These Terms of Service ("Terms") govern your use of the website hdr-mediapro.com(the "Site") and the real estate media services provided by HDR Media Pro LLC("HDR Media Pro," "we," "us," or "our").
By accessing the Site or booking our services, you agree to be bound by these Terms. If you do not agree, please do not use our Site or services.
1. Services Provided
HDR Media Pro provides professional real estate media services, including but not limited to aerial drone photography, videography, 3D site mapping, and virtual tours. The specific services to be delivered will be outlined in your booking confirmation or service agreement.
2. Booking and Cancellation
- BookingAppointments are confirmed only after a booking request is accepted by us. We reserve the right to decline any booking.
- CancellationsCancellations or reschedules must be made at least 24 hours prior to the scheduled shoot. Late cancellations may be subject to a cancellation fee.
- Weather PolicyDrone operations are strictly dependent on weather and FAA regulations. We reserve the right to reschedule shoots due to unsafe flying conditions (e.g., high winds, rain) at no additional charge.
3. Property Readiness
The Client is responsible for ensuring the property is "shoot-ready" upon our team's arrival. This includes:
- Cleaning and decluttering all interior and exterior spaces.
- Ensuring all necessary lighting is functioning.
- Securing pets and notifying tenants or neighbors if required.
Our team will photograph the property as-is. We do not provide cleaning or staging services on-site unless explicitly agreed upon in advance. Wait time due to an unready property may incur additional hourly fees.
4. Intellectual Property and Licensing
Copyright Ownership: HDR Media Pro retains all copyright and intellectual property rights to all media (photos, videos, virtual tours) created, unless a full copyright buyout is negotiated in a separate written agreement.
Client License: Upon full payment, the Client is granted a non-exclusive, non-transferable license to use the media for the specific purpose of marketing the photographed property.
- The media may be used on the Client's website, MLS listings, social media, and print materials.
- The license expires when the property is sold or the listing expires, unless otherwise agreed.
- Media may not be sold, transferred, or gifted to third parties (such as builders, stagers, or other agents) without explicit permission and licensing from HDR Media Pro.
5. Payment Terms
- InvoicingInvoices will be sent upon delivery of the final media or as otherwise outlined in your agreement.
- Payment DuePayment is due in full within the timeframe specified on the invoice. We accept major credit cards and bank transfers.
- Late FeesOverdue invoices may accrue a late fee of 1.5% per month.
- DeliveryFinal, high-resolution media will not be released for download until full payment is received, unless the Client has an established account in good standing.
6. Revisions and Retouching
Standard editing (color correction, basic exposure adjustments, minor blemish removal) is included in our service packages.
Advanced retouching (e.g., twilight conversion, sky replacement, object removal, virtual staging) must be requested specifically and may incur additional per-image fees. We allow one round of reasonable revisions for video projects; subsequent edits will be billed at our hourly rate.
7. Limitation of Liability
To the maximum extent permitted by law, HDR Media Pro shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising out of or related to your use of our services or Site.
In no event shall our total liability to you for all damages exceed the amount you paid us for the specific services giving rise to the claim.
8. Safety and Compliance
All aerial drone operations are conducted by FAA Part 107 certified pilots. We strictly adhere to all federal, state, and local aviation regulations.
The pilot in command has final authority regarding the safety of a flight. If a flight cannot be conducted safely or legally (due to airspace restrictions, weather, or hazards), we reserve the right to alter or cancel the aerial portion of the shoot.
9. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law principles. Any legal action or proceeding arising out of these Terms shall be brought exclusively in the state or federal courts located in Sarasota County, Florida.
10. Changes to Terms
We may update these Terms from time to time. We will notify you of any material changes by posting the new Terms on this Site and updating the "Last Updated" date. Your continued use of the Site or services after such changes constitutes your acceptance of the revised Terms.
